Terms of Service

LinkdAPI provides API access to publicly available professional and business data through structured endpoints. We are an independent data platform and do not provide access to private or proprietary third-party systems, accounts, or authenticated areas of any platform. We are not affiliated with, endorsed by, or sponsored by any third-party platform.

LinkdAPI aggregates information from publicly accessible sources on the open web, including public profile pages, public company directories, public job listings, public articles, and other publicly available content. We do not access, store, or distribute private, password-protected, or non-public data, and we do not bypass authentication or technical access controls of any third-party platform.

We respect website operators' technical signals (such as robots.txt and rate limits) and comply with applicable data protection laws governing the lawful processing of public information. Our customers remain solely responsible for their downstream use of any data retrieved through the API in accordance with applicable laws and any third-party terms that may apply to their use case.

You agree to use LinkdAPI in compliance with all applicable laws and regulations, including but not limited to:

• Data protection laws (GDPR, CCPA, and equivalent regimes)
• Anti-spam regulations (CAN-SPAM, CASL, GDPR direct-marketing rules)
• Intellectual property laws
• Third-party terms of service applicable to your use case

Prohibited activities

• Using the service for spam, harassment, doxxing, stalking, or any unlawful activity
• Attempting to reverse engineer, probe, or compromise our infrastructure or rate limits
• Reselling, sublicensing, or repackaging API access without our prior written authorization
• Building or distributing competing data platforms substantially derived from our service
• Collecting or processing personal data for purposes incompatible with the original public context, or without a lawful basis where required
• Training, fine-tuning, or evaluating machine-learning models on data retrieved through the API without rights appropriate to that purpose
• Performing mass enrichment of personal data without a lawful basis or where the affected data subjects have objected to such processing
• Violating any applicable privacy or data protection laws

You are solely responsible for:

• Your use of any data obtained through the API
• Compliance with applicable laws, regulations, and third-party terms
• Securing your API credentials and any access tokens issued to you
• The accuracy of information you provide to us during signup, billing, or support
• Honoring requests from data subjects you process, including erasure and rectification, where you act as a controller

• We strive for 99.9% uptime but do not guarantee uninterrupted service.
• We reserve the right to modify, suspend, or discontinue the service or any endpoint at any time.
• We may implement rate limits, fair-use thresholds, and abuse protections to ensure quality of service.
• Planned maintenance will be communicated in advance when reasonably possible.

• We act as a service provider delivering API infrastructure; we do not retain end-user data beyond transient processing.
• You retain ownership of data you retrieve through the API, subject to applicable third-party rights.
• We do not store retrieved API responses beyond a temporary cache (maximum 1 hour).

• Our API, documentation, SDKs, brand, and platform remain our intellectual property.
• You receive a limited, revocable, non-exclusive license to use the service as intended.
• You may not copy, modify, redistribute, or create derivative works of our technology.
• Feedback you submit may be used by us without restriction or compensation.

Use of the API is metered in credits. Credits may be purchased in advance via supported payment methods or granted as part of a subscription plan. Pricing is published on our website and may be updated with reasonable notice. Taxes, where applicable, are added at checkout or remitted by our merchant of record.

You are responsible for ensuring sufficient credit balance for your usage. We may suspend access for non-payment, failed payments, or chargebacks. Refunds and cancellations are governed by our Refund Policy.

• The service is provided "as is" and "as available" without warranties of any kind, express or implied.
• We are not liable for indirect, incidental, special, consequential, or punitive damages.
• Our aggregate liability arising out of or relating to the service is limited to the fees you paid us in the twelve (12) months preceding the claim.
• We do not guarantee data accuracy, completeness, fitness for a particular purpose, or continuous availability.

You agree to indemnify, defend, and hold harmless LinkdAPI, its affiliates, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the service, (b) your violation of these Terms, (c) your violation of any law or third-party right, or (d) your use of data retrieved through the API.

We may update these Terms from time to time. Continued use of the service after changes take effect constitutes acceptance of the updated Terms. Material changes will be communicated by email to the address on file or by prominent notice within the platform.

We may terminate or suspend access immediately for:

• Violation of these Terms or our Acceptable Use Policy
• Fraudulent, abusive, or illegal activity
• Non-payment of fees or repeated chargebacks
• Risk to the security or integrity of the service or other users
• At our discretion with thirty (30) days' notice for non-cause termination

Upon termination, your right to use the service ends immediately. Sections that by their nature should survive termination (including IP, indemnification, liability limits, and governing law) will survive.

These Terms are governed by and construed in accordance with the laws of Wyoming, United States, without regard to its conflict-of-laws principles. The parties consent to the exclusive jurisdiction and venue of the state and federal courts located in Wyoming, United States for any dispute not subject to arbitration.

Before initiating any formal proceedings, the parties will attempt in good faith to resolve any dispute by negotiation. Both parties waive the right to participate in any class action, class arbitration, or representative proceeding to the maximum extent permitted by law. Nothing in this section limits either party's right to seek injunctive relief in respect of intellectual property or confidential information.
